- Abstract
The article examines the limitations of the U.S. Supreme Court case Hamdan versus Rumsfeld and the provisions of the Military Commissions Act of 2006 (MCA). The court sets aside the order of President George W. Bush providing for trial by military commission of non-citizens suspected of association with the al Qaeda terrorist organization and apprehended during the Afghanistan conflict. It examines the aspects of the Hamdan ruling rejected by the MCA.
