The article focuses on Rule 23 of the Federal Rules of Civil Procedure which authorizes class actions as a form of aggregate litigation in the United States. The class action must meet the predominance requirement or the manageability standards. However, the state choice-of-law rules create a situation in which the court deciding the case has to apply the laws of different states to the different class members.
