Not Just Kid Stuff? Extending Graham and Miller to Adults.
- Authors
O'Hear, Michael M.
- Abstract
The article focuses on extension of the Eighth Amendment protections that prohibits life imprisonment without parole (LWOP) to adult defendants with reference to the U.S Supreme Court's ruling in case Graham v. Florida and Miller v. Alabama that prohibited sentences of LWOP for juveniles. Other Supreme Court cases include Harmelin v. Michigan that involved mandatory LWOP sentence for a drug crime and Ewing v. California based on California's draconian "three-strikes" law.
