- Title
MOMMY OR DADDY AND ME: A CONTRACT SOLUTION TO A CHILD'S LOSS OF THE LESBIAN OR TRANSGENDER NONBIOLOGICAL PARENT.
- Authors
O'Bryan, Kelly M.
- Abstract
In this article, the author discusses common law and statutes that courts apply with parentage claims of nonbiological parents like lesbians for children born from artificial insemination (AI) in the U.S. The author says that the 1973 Uniform Parentage Act (UPA) excludes unmarried couples and their children in its protection. The author also relates that the 2000 UPA focuses on the intent of nonbiological parents to parent a child but refuses its application for lesbian nonbiological parents.
