The article discusses the applicability of the international law of armed conflict at the beginning and end of war, focusing on justiciability, separation-of-powers interests, and judicial review under Article III of the U.S. Constitution. America's Military Commissions Act of 2009 (MCA), rulings by the nation's Supreme Court, and a political question doctrine in the U.S. are examined. American counterterrorism efforts, the Al Qaeda terrorist group, and several legal cases are assessed.
