The article reports the decision of the U.S. National Labor Relations Board's in the Babcock & Wilcox Construction Co. Inc. case. It discusses how a female construction worker's plight moved the Board to change its longstanding arbitral deferral standard. It reports that based on alleged fairness her employer was granted a get-out-of-jail-free card.
