- Title
Recoverable Costs Can Exceed Policy Limits.
- Abstract
The article discusses a California court case involving a person who was injured in a car accident with an uninsured driver. The person filed a petition to compel arbitration with his insurance company, Farmers Insurance, to pay him damages under the uninsured motorist provisions in his policy. Besides this, he wanted the company to pay for court costs. The court denied his appeal for the extra costs because the amount exceeded his policy limit. The Court of Appeal reversed the decision, which was further backed up by the California Supreme Court. Details concerning the procedures and amounts rewarded are given.
