- Abstract
Various groups are currently working on the reform of forensic psychiatric addiction treatment according to Sect. 64 of the German Criminal Code (StGB). A task force of the German Society of Psychiatry, Psychotherapy and Neurology DGPPN proposes that consent to treatment and motivation for therapy should be included in the legal text as mandatory requirements for a placement in forensic psychiatric addiction treatmtent. These suggestions will be critically discussed from a psychological perspective and in view of empirical data from the German »Reference Date Survey 2020«. The requirement of willingness for treatment as well as intrinsic motivation to change to be present at the beginning of the placement in heavily drug-dependent individuals does not appear plausible from a professional perspective. Rather, the promotion of motivation should be an integral part of the treatment - at the beginning and continuously. In addition, the evaluation of the data from the Reference Date Survey suggests that if therapy motivation is required a large number of patients in need of therapy would probably no longer be referred, but rather more patients who are currently often regarded as misallocated.
