- Abstract
Cash bail is a system in the United States where individuals who cannot afford to pay the full bail amount remain in jail indefinitely, while those who can pay are able to secure their release. This practice has been criticized for violating due process rights and disproportionately affecting Black and brown individuals. Several states, including Illinois, New Mexico, New Jersey, and Kentucky, have taken steps to reform or abolish cash bail. However, in Georgia and other Republican-led states, efforts are being made to expand the use of cash bail, which is seen as a cynical ploy that perpetuates racial disparities in the criminal justice system.
