- Abstract
The article discusses a court case, Exxon Shipping Inc. v Baker, wherein a jury found that Exxon Shipping Inc. and the captain of the tanker Exxon Valdez, Joseph Hazelwood, were liable and awarded punitive damages of $4 billion. After reviewing the Supreme Court precedents, a second judgment was announced increasing the punitive damages to $5 billion. However, the 9th Circuit Court of Appeals in 2007 has decided to reduce the punitive award against Exxon-Mobil to $2.5 billion.
