- Abstract
The article focuses on concerns related to over criminalization in victimless crimes including pornography, gambling, and most notably drug crimes in the U.S. It presents information on a constitutional framework using human dignity as a constitutional constraint on the judicial power to criminalize victimless crime and analyzes the U.S. Supreme Court jurisprudence in this context. It discusses guidelines that distinguishes drug trafficking and drug use.
