- Abstract
The author focuses on the general theory of fair use in section 107 of the 1976 Copyright Act in the U.S. He stresses that fair use is the product of custom that in other countries, much of activity including a photocopy, a paragraph copied into an article, and quotation in a book review, falls under rarely-tested legal head of fair dealing. He emphasizes that intellectual exercise gets to discern a higher order at work that may explain the appeal of an encompasssing theory of fair use.
