- Abstract
The article addresses other property damage disputes in the U.S. that emphasizes both contract and tort law. It discusses the use of the economic loss doctrine by the courts to determine whether a defective product liability should proceed as a tort or contract case. It mentions that the primary factor motivating the economic loss doctrine is the availability of the Uniform Commercial Code (UCC) in the country to address conflicts over a performance of the product.
