HALEY, JOHN O.
- Abstract
The author discusses his opinion on judicial review in Japan such that it has become a crucial factor in achieving political solutions through the democratic process. The postwar Constitution expanded the existing means of redress through the abolition of the administrative court system and the provision of judicial review. Doctrines that restrict one's right to sue and limit reviewable administrative actions were present along with constrained conceptions of judicial power and judicial remedies that were available.
