- Abstract
The article discusses the use of statistical analysis to prove intentional employment discrimination. Statistical proof of a claim of intentional exclusion is important because it helps the U.S. Supreme Court resolve conflict concerning subjective interviews and is necessary in cases brought under the Civil Rights Act of 1866. In a hypothetical job interview, the component parts are the evaluation of general demeanor, which might include a subjective assessment of the personal characteristics of an applicant and an informal test incorporated into the oral interview. Employment discrimination can either have an invidious intent or intent to act with reckless disregard of consequences.
