COMPARATIVE SENTENCING PRACTICE.
- Authors
MANNHEIM, HERMANN
- Abstract
The article focuses on the comparative sentencing practice in some European countries. As stated, judicial sentencing practice depends on several factors such as the state of the criminal law, the forms of legislative guidance regarding the choice of sanctions, and the state of crime and economic conditions at a given time in a certain area. It states that measures of preventive detention and security have been introduced for habitual and dangerous offenders and mentally abnormal persons. The article offers detailed information for Denmark where the courts facing the difficulties of the occupation period, adopted a firmer attitude towards offenders.
