- Abstract
The article analyzes the need for a legislation for extending the benefits of workmen's compensation to railroad employees and their dependents based on the liability of the employer regardless of fault. It is stated that, currently under the U.S. Federal Employers' Liability Act (FELA), action can be taken only if the negligence is on the part of the railroad, so that their is no liability unless and until negligence is proved to the satisfaction of the jury. However, as stated, under workmen's compensation laws employees are insured against the results of injuries received in the course of their employment, without reference to their contributory negligence, and without reference to common law liability.
