- Title
PROBLEMS OF THE ITALIAN PEACE TREATY: ANALYSIS OF CLAIMS PROVISIONS AND DESCRIPTION OF ENFORCEMENT.
- Authors
SURREY, WALTER STERLING
- Abstract
The article discusses the claims provisions and enforcement of the Italian Peace Treaty. The U.S. has limited its claims to two categories that include the utilization of Italian assets within the U.S. to the extent necessary for the satisfaction of its claims and those of its nationals and claims for the return of U.S. property and property of its nationals located in Italy. As mentioned, there is a need to find a better way in the treaty to deal with the claims of property damage. As mentioned, the disposition of claims for personal injury cases in the Lombardo Agreement provides a more practical framework for handling the property damage claims. As mentioned, a comparable procedure is available in the treaty.
