- Abstract
It is undisputed that the idea of criminal responsibility of legal entities today is a reality in modern legal systems, but also that the introduction of legal entities as subjects in criminal law opens new issues that will need to be resolved and harmonized in the legislation and the judicial practice. Legal entities are usually punished with the application of property sanctions and measures, in particular fine, but also with other penal sanctions and measures adapted to their nature, such as placing under judicial supervision, banning market access or offering a market offer , closing the enterprise, temporarily or permanently, and so on. Legal entities are recidivist, can be punished conditionally, rehabilitated, have a court registry. The procedure for the enforcement and enforcement of penal sanctions against them is largely harmonized in many legal systems today, but their implementation opens some disputable issues related to the basic characteristics of the sanction in general and the purpose of the punishment, especially when applying the most commonly punished punishment to them, the fine.
