- Abstract
For the first time, the concept of hate crimes in our legislation is incorporated with the adoption of the 2009 amendments to the Criminal Code when it is envisaged that the court will take into consideration whether the crime was committed due to the victim's belonging. By doing so, the act of the offense for some discriminatory basis in the general provisions of the Criminal Code has been raised to the level of a general aggravating circumstance. After the adoption of the Law on Prevention of Discrimination of 2010 in 2014, appropriate amendments to the Criminal Code were made in order to harmonize it with the grounds for discrimination stipulated in that law. The protective characteristics of Article 3 of the Law on Prevention and Protection against Discrimination were reproduced in Article 39 (5) of the Criminal Code as aggravating circumstances in determining the punishment if the crime was "committed against a person or group of persons or property, directly or indirectly, due to their belonging to a certain sex, race, color of skin, gender, belonging to a marginalized group, ethnicity, language, citizenship, social origin, religion or religious belief, other types of beliefs, education, political affiliation, personal or societies q status, mental or physical disability, age, family or marital status, property status, health condition or any other grounds provided by law or by international agreement. "
