- Abstract
The article discusses what the author refers to as the late U.S. Supreme Court Justice Antonin Scalia's flawed views regarding the law of takings (eminent domain), and it mentions two majority opinions which were issued by Scalia in the takings-related cases Nollan v. California Coastal Commission and Lucas v. South Carolina Coastal Council. The takings and zoning regulation litigation matter Agins v. City of Tiburon is addressed, along with a substantially advance takings test.
