- Abstract
The article discusses American common law and the U.S. Constitution in relation to a ruling by the nation's Supreme Court in the 2014 case Marvin M. Brandt Revocable Trust v. United States which deals with U.S. property law, the legal aspects of a railroad right-of-way, and a dispute over a proposed recreational trail. Easements are mentioned, along with litigation involving abandoned railroad lines and the U.S. National Trails System Act Amendments of 1983 (Rails-to-Trails Act).
