- Abstract
The article discusses the impact of the U.S. Supreme Court's holding in the Melendez-Diaz case on autopsy reports as evidentiary tools in criminal cases. It provides a background on autopsy reports and forensic pathology and the history of the Sixth Amendment's Confrontation Clause that led to the Melendez-Diaz. It cites the lean rule as an alternative for Medical Examiners (ME) that can be used if the ME is unavailable. It suggests for MEs to consider a lean autopsy report structure and divide testimonial opinions from nontestimonial observations.
