The article argues on the need for legislatures to adopt a model statute that protects off-duty conduct of private employees in the U.S. It explores the increasing growth and importance of Internet communication through social networking and blogs. It examines why the types of communication are not protected for private employees. It proposes a model statute that addresses the policy considerations for employers and employees.
