- Abstract
The article reports on the case of NCP Marketing Group Inc. against B G Star Production which involves trademark license possession in U.S. bankruptcy proceedings. It notes that Chapter 11 of the Bankruptcy Code offers a debtor with the opportunity to continue his or her business operation while going through legal proceedings that is preferred to business liquidation and assets. An overview on the application of hypothetical test by the nation's Courts of Appeals in the case is also discussed.
