- Title
The Promissory Character of Adequate Assurances of Performance.
- Authors
Borden, Michael J.
- Abstract
The article discusses the doctrine of adequate assurances of performance which refers to the non-performance of one party in the initiation of the contract. It states that non-compliance of one party gives frustration to the aggrieved party and due to frustration, the aggrieved party would just like to end the contract. In so doing, the aggrieved party can be blamed for breach of contract. Anticipatory repudiation assists frustrated parties and non-performing parties to come to a suitable action before a deadline and to render positive results.
