- Abstract
Matters of jurisdiction and applicable law are of considerable importance to parties to litigation; it is of course convenient for claimants to issue proceedings within their home jurisdiction, and different jurisdictions have different procedural rules. In some jurisdictions, for example, costs are irrecoverable, whereas in others costs awards may run to six figures or more. Clearly parties are always keen to minimise risk and maximise recovery, and issues of appropriate jurisdiction and applicable law are now coming to the fore in the wake of a number of important recent decisions in the area.
