- Abstract
Justice policy is connected with the objective of protecting the public from harm. At first sight, this makes penal policy particularly susceptible to populist tendencies. Various international analyses corroborate this assumption. However a closer look reveals that populism is a malleable and fuzzy concept, especially when it comes to penal policy. Against this background, this contribution attempts to delineate populism in the context of German justice policy. The empirical basis of this endeavor is comprised of an analysis of three recent prominent political campaigns and an examination of parliamentary debates in the German Bundestag, Bundesrat and four state parliaments ranging from 1970 to 2009.
