- Title
Religion Clauses: The Case for Separating Church and State. By Howard Gillman and Erwin Chemerinsky.
- Authors
Cook, Edwin
- Abstract
They propose variant interpretations of the two religion clauses (Establishment and Free Exercise), namely separation/separation, separation/accommodation, accommodation/separation, and accommodation/accommodation. In this regard, Gillman and Chemerinsky fail to adequately express the broader nature of protections granted under the Free Exercise clause. By stripping away SCOTUS's role of strict scrutiny and accommodation for minority religious groups, the authors' attempt to interpret the Free Exercise clause falls short of the mark.
