Abstract
The article reports that the U.S. Court of Appeals for the First Circuit held that a minor beneficiary of an employee benefit health plan stated a valid claim under the Mental Health Parity and Addiction Equity Act (MHPAEA) on its face by pointing to text in a health insurance plan for physical impairments. It mentions that the MHPAEA claim applied to the beneficiary by alleging the insurer had assumed treatment to be nonrestorative upon learning of the beneficiary's autism spectrum disorder.
