- Abstract
The article discusses the U.S. court case Parra vs. Pacificare of Arizona wherein one of the plaintiffs, who was injured in a car accident, argued that the Medicare Advantage Organization plan could not seek recovery against them. The Ninth Circuit court affirmed and the court analyzed the medical services plan (MSP) provisions of the Medicare Act. The court ruled that the plan may not maintain federal private action against insured for reimbursement and state suit is possible.
