- Abstract
The article discusses the case of the Grand River Enterprises Six Nations Ltd. which raises concerns surrounding investment arbitration under the North American Free Trade Agreement (NAFTA) chapter 11 for the tobacco industry. It offers an overview of the U.S. regulatory context and the investors' claim and further looks into the treatment of the standards of the international law. It highlights the effectiveness of the schemes of the investment arbitration for the protection of public health.
