- Abstract
Objective: To analyze the principle of participation in Environmental Law, identifying its conceptual foundations, its application, and the mechanisms of participation. Methodology: The methodology adopted is based on a literature review, aiming to explore the contributions of the main authors in the field of Environmental and Constitutional Law. Results and data analysis: The results highlight the importance of popular participation as a fundamental democratic principle in the context of Brazilian Environmental Law. The need for society's awareness in various areas, such as educational, community, and religious, to boost effective participation in environmental decisions is emphasized. Legal instruments such as popular action and public civil action are mentioned as means to ensure citizen participation. Furthermore, the need for reformulation of environmental agencies, with an emphasis on democratizing councils, to promote more representative participation is pointed out. The role of the Public Ministry in monitoring and protecting the environment is also highlighted. Thus, it is concluded that active citizen participation is crucial to ensure fair and sustainable environmental policies, requiring education, awareness, and mobilization of society. Research Implications: In practical terms, the implications of the research include identifying challenges and gaps in the current structure of social participation in environmental issues, as well as suggesting possible measures to overcome them. This can influence public policies and environmental management practices, encouraging the implementation of more effective mechanisms of popular participation and promoting greater transparency and accountability in the decision-making process. Originality/Value: The article stands out for its relevance in examining the application of the democratic principle in Brazilian Environmental Law, focusing on the precepts of the Federal Constitution of 1988. It stands out for its specific approach on how society's participation can contribute to sustainable environmental policies, emphasizing the importance of active citizen involvement in decision-making and awareness of environmental issues.
