- Abstract
The article focuses on the basic principles of property law such as numerus clausus and type restriction and its implications on the practice of legal commerce. It discusses the influence of the said principles through various examples such as content of servitudes, the provision of real rights for flat-owner agreements and the admissibility of rights for co-owner deals. It offers an evaluation of the fixed type restriction in terms of the establishment of real rights' contents concerning sales interests. It adds that the significance of the principles are assessed using the German, Swiss and Estonian law.
