- Abstract
The article determines specific deficiencies in domestic and international legal frameworks and options for promoting equilibrium between economic development and indigenous rights. It explores the impact of commercially motivated activities of multinational enterprises (MNEs) on indigenous peoples over time. It discusses recent legal developments regarding protection of indigenous peoples from threats associated with foreign direct investment (FDI), including the endorsement of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) by the U.S. President Barack Obama. It suggests that indigenous people should be given an access to a neutral forum to pursue claims against MNEs for violations of UNDRIP.
