- Abstract
The article discusses the constitutionality of military commissions authorized by U.S. President Barack Obama which are designed to adjudicate matters involving suspected terrorists who are being held at an American detention center in Guantanamo Bay, Cuba as of April 2012. The U.S. Supreme Court's assessment of American military tribunals is examined in cases such as Hamdan v. Rumsfeld. Dicta from the judges of the U.S. Court of Appeals for the District of Columbia Circuit is also assessed.
