- Abstract
The purpose of this work is to find out how new labor identities have diversified the constitution of the “union map" and how legal institutions have entered into crisis with the development of a litigation culture for union claims. To accomplish this, the study refers not only to the principle empirical works on the topic, it also enters into the constitutional debate expressed in the courts, from the perspective of the judge. The research is documentary, concluding that the constitutional argument, based on the nondiscrimination principle, has become a useful strategy as the only means for obtaining institutional protections for alternative union sectors that were found to be in conflict when facing situations of dismissal.
