REFEREE IN BANKRUPTCY MAY NOT SIGN AN ORDER CONFIRMING AWARD WHEN FEDERAL COURT IN BANKRUPTCY PROCEEDINGS "RESTRAINED AND ENJOINED" ALL CREDITORS OF RESPONDENT "FROM TAKING ANY FURTHER STEPS OR PROCEEDINGS, EXCEPT BEFORE THIS COURT," UNTIL THE FURTHER ORDER OF THAT COURT.
- Abstract
This article focuses on the court judgment given in Myers v. Mineola Mack Distributors case. Referee in bankruptcy may not sign an order confirming award when federal court in bankruptcy proceedings "restrained and enjoined" all creditors of respondent "from taking any further steps or proceedings, except before this court," until the further order of that court. Since no court order was obtained, entry of judgment on the award was denied.
