- Title
RAPE AS A VARIANT OF FORNICATION (ZINA) IN ISLAMIC LAW: AN EXAMINATION OF THE EARLY LEGAL REPORTS.
- Authors
Azam, Hina
- Abstract
The article evaluates whether the Islamic law accounts for a distinct typology for rape and fornication by analyzing legal reports of opinions of formative discourses of religious authorities. Legal professional Asifa Quraishi mentions that the law does not account rape as a variant of fornication but a type of bodily injury. Karamah Muslim Women Lawyers for Human Rights, a non-profit organization, published a paper suggesting that Islamic law depict fornication and rape as distinct acts.
