- Abstract
The review deals with European state aid law in the field of sports and state funding in the sports sector. The author, Lukas Reiter, extensively examines the legal issues related to the financial support of the sports sector in his dissertation. He addresses topics such as sports infrastructure, sports entities, and sports events. Reiter's work is convincing in terms of content and presents the dimension of state aid law in sports law. However, it is noted that a definition of the term "sport" is missing and that the impact of the COVID-19 pandemic and eSports is not sufficiently taken into account. The text describes Austrian sports funding and emphasizes that the involvement of gambling companies as "pass-through institutions" under state control and supervision does not change the state nature of sports funding. It also addresses the promotion of major sports events in connection with the acquisition of TV rights by public broadcasting. The question of whether program fees and advertising revenue constitute state aid within the meaning of Article 107(1) TFEU is also discussed. Various areas in the sports sector are examined to demonstrate when an economic and non-economic activity is present. It also addresses distortions of competition and impairment of trade. Overall, the dissertation provides a comprehensive overview of sports law and state aid literature.
