The article discusses the constitutionally protected due process and the use of criminal intelligence provisions. Topics discussed include a history of due process protection in the Australian case law and literature, High Court authority apparently validating the use of criminal intelligence provisions, and the use of due process considerations to challenge the constitutional validity of criminal intelligence provisions.
