The article reassesses the efficacy of international investment agreements and investment arbitration. It mentions that Australia faces problems in terminating existing Bilateral Investment Treaties. It further challenges the Australian Productivity Commission's contention that investor-state arbitration should be rejected as it is inferior to the mechanisms of dispute resolution.
