- Abstract
The article examines the near-total denial of fair hearing rights under the Australia law to non-permanent resident non-citizens who are considered being national security risks in Australia. It illustrates the legal issues involving the denial of procedural fairness in a range of other cases from asylum seekers to the cause celebre of American peace activist Scott Parkin. It concludes the denial of fair hearing rights to nonpermanent residents amounting to unjustifiable discrimination.
