- Abstract
The article discusses the elements of an effective bid protest forum while analyzing the bid protest systems of the U.S. states of Alabama, Massachusetts, and Maryland. It also evaluates the effectiveness of state and federal courts as a bid protest forum giving examples from the courts of Minnesota. It compares the Agreement on Government Procurement, the United Nations Commission on International Trade Law Model Law on Public Procurement, and the Model Procurement Code as models for reform.
