PROCEDURAL EXTREMISM: THE SUPREME COURT'S 2008-2009 LABOR AND EMPLOYMENT CASES.
- Authors
Hart, Melissa
- Abstract
The article highlights several U.S. employment cases. In the case Ricci v. DeSteffano, New Haven was found by the U.S. Supreme Court to have discriminated against white firefighters, which had been a landmark as it suggested reconciling the disparate impact and disparate treatment provisions. The case Ashcroft v. Iqbal involved a Pakistani, who was imprisoned after the September 11, 2001 attack, filing charges against former Attorney General John Ashcroft, in which he claimed that Arab Muslims are highly targeted after the attack.
