- Abstract
This article analyzes police motivations for violating the U.S. knock-and-announce rule, considers why remedies are ineffective and suggests enhanced judicial and administrative remedies. It recommends enhanced administrative measures that enforcement agencies can utilize to encourage police officers to respect the Fourth Amendment and citizens' privacy rights. It gives public policy arguments that the Supreme Court considered in the case Hudson v. Michigan. In addition, this article discusses factors that affected a plaintiff's ability to recover for his or her injuries through the courts.
