- Abstract
The Spanish government has approved a large number of extraordinary measures to reduce the adverse effects of the pandemic on vulnerable groups. The effectiveness of such measures could be challenged. Concerning leases, and in order to facilitate rental payment, RD-L 11/2020 introduced certain relief measures for vulnerable residential lessees. Shortly thereafter, and in relation to commercial leases, RD-L 15/2020 approved measures to protect the self-employed and small and medium-sized enterprises (SMEs). More recently, RD-L35/2020 has been passed as a "continuation and improvement" of the latter. Two other pieces of legislation also include measures aimed at specific types of commercial leases. In addition, at a regional level, the Catalonian government has passed D-L 34/2020, which allows commercial lessees whose activities have been suspended or have been affected by restrictions on the use of their rented property to obtain from their lessors partial reductions in rent and other expenses. Therefore, at the moment, there are two regulations (RD-L 35/2020 and D-L 34/2020) in Catalonia on the same subject matter, a situation which raises vast uncertainty.
