- Abstract
Judicial privileges were at the forefront of the privileges that the Ottoman State granted to the United Kingdom through capitulations since 1580. British Consuls took on the task of serving as judges in criminal and civil cases in the consular courts of citizens of British nationality living in the territory of the Ottoman State. These powers granted to the consuls were based on a statutory principle through the decrees British Government had issued on different dates. Some new regulations were also made with the same decrees. The most important of these regulations are the Decree of 1843, which sets out the legal procedure British Consuls will follow in judicial proceedings, and the Decree of 1864, which opened the British High Consular Court. This court settled the cases in the region of Istanbul, and also served as a judicial authority for appeals. Thus, if objections were made against the decisions taken, the cases would be held again.
