EMPLOYER'S COMPENSATION TO UNION MEMBERS ON GRIEVANCE BOARD -- ARBITRATOR'S DECISION -- LEGALITY OF METHOD UPHELD BY COURT.
- Abstract
The article focuses on a court case related to employer's compensation to Union members on grievance board. Arbitration award finding that the company was bound by prior agreement to compensate the Union members of grievance board and that it did not have the right to make a unilateral change in that plan, was upheld by Court after it ruled such method of compensation to be legal. The court stated that the company's compliance with the arbitration award is contingent on the legality of the method the arbitrator upheld. The Court found that such method, by which the employer paid wages to his employees for time spent attending grievance meetings as members of the Board of Adjustment, did not violate provision of the U.S. National Labor Relations Act prohibiting an employer from paying, lending, or delivering anything of value to any representative of its employees.
