- Abstract
The article evaluates the court case "United Aircraft International Inc. v. Greenlandair Inc.," related to arbitrability of negligence claim in purchasing agreements. In this case, the court ruled that where agreement for the purchase of helicopters contained a broad arbitration clause stating that any dispute arising under this contract shall be settled and finally determined by arbitration, buyer's claim for damages resulting from a crash of one of the helicopters was arbitrable, notwithstanding warranty provision to the effect that buyer is left to whatever remedies it might have at law for any claim of negligence. After determining that commerce was involved, the court held that there was nothing incongruous about permitting arbitrators to resolve a dispute over conduct for which the law provides a remedy.
